DMCA Copyright Policy

HitScanTCG respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This page explains how to submit a takedown notice, how users can submit a counter-notice, and our designated agent for service.

1. Designated DMCA Agent

HitScanTCG LLC has designated the following agent to receive notifications of claimed infringement under the DMCA. Notices sent to any other address may not be processed promptly.

2. Filing a Takedown Notice (Section 512(c)(3))

If you believe content on HitScanTCG infringes a copyright you own or are authorized to represent, send a notice to dmca@hitscantcg.com that contains all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if a single notice covers multiple works at HitScanTCG).
  3. Identification of the material claimed to be infringing and that is to be removed, including information reasonably sufficient for us to locate it (for example, the URL of the listing, profile, or page).
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Notices that omit any of the above may be insufficient under the DMCA and may not result in removal. Knowingly materially misrepresenting that content is infringing may subject you to liability for damages under 17 U.S.C. § 512(f).

3. Our Response to a Valid Notice

  • We review every notice received at the designated agent address.
  • Upon receipt of a notice that complies with § 512(c)(3), we will remove or disable access to the identified material expeditiously and notify the user who posted the material.
  • We may retain a record of the notice and the removed material as required by law and for our own recordkeeping.
  • We do not provide pre-removal notice to the allegedly infringing user. That user may submit a counter-notice as described in § 4.

4. Counter-Notice (Section 512(g))

If you believe material you posted was removed in error or misidentification, you may submit a counter-notice to dmca@hitscantcg.com. A valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the removed material and its location before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the U.S. District Court for the district in which your address is located (or, if outside the U.S., of the U.S. District Court for the Western District of Washington) and that you will accept service of process from the original notice sender or their agent.

On receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not file a court action seeking a restraining order against the user within 10 business days, we will restore the removed material within 14 business days of receipt of the counter-notice, subject to our other policies.

Knowingly materially misrepresenting that content was removed by mistake may subject you to liability for damages under 17 U.S.C. § 512(f).

5. Repeat-Infringer Policy

HitScanTCG maintains a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers of copyright. Repeat-infringer determinations are made on a case-by-case basis considering the number, scope, and recency of infringement notices and any counter-notices, and our own investigation of the conduct.

6. Trademark and Other IP Complaints

This page addresses copyright complaints under the DMCA. For trademark infringement, unauthorized use of a trademark, or other (non-copyright) intellectual property concerns, contact legal@hitscantcg.com with:

  • Your identity and a good-faith claim of authorization to act on behalf of the rights holder.
  • Identification of the mark or right at issue, including registration details if applicable.
  • Identification of the allegedly infringing content on HitScanTCG.
  • A description of the harm and requested remedy.
