Anti-Gambling Policy

HitScanTCG is a retail marketplace for identified, sealed trading card products. It is not a gambling, sweepstakes, lottery, or prize-promotion platform. This Policy describes the chance-based activities that are prohibited on HitScanTCG. Violation is grounds for immediate suspension or termination of your account.

1. Why This Policy Exists

Every HitScanTCG listing is a sale of a specifically identified sealed product at a fixed price. The Viewer knows exactly what product they are purchasing. Pack contents are pre-determined by the manufacturer and are received in full by the Viewer. This structure is ordinary retail commerce, not gambling. To remain in that retail posture — and to protect Streamers and Viewers from legal risk — HitScanTCG prohibits any activity that reframes the transaction as a chance, draw, or wager.

2. Prohibited Activities on HitScanTCG

2.1 Chance-based products

You may not list or sell, on HitScanTCG, any of the following:

Mystery packs. A listing where the specific set and product are not disclosed before purchase.
Random packs. "Random Pokemon pack" or similar listings that reveal the set or product only after sale.
Grab bags. Listings that bundle unidentified or undisclosed packs, singles, or accessories.
Slabs, graded cards, or singles sold blind. Any listing where the specific card is hidden.
Hit chance packs. "Guaranteed hit" or "1 in X chance of [card]" framing, even if the pack itself is identified.
Repack product. Products that have been opened, searched, weighed, re-wrapped, or otherwise compromised before being sold as sealed.

2.2 Chance-based promotions

You may not conduct any of the following on your HitScanTCG store or livestream:

Raffles. Selling entries to win a prize, whether for money or "free" with a purchase.
Sweepstakes. Free-entry prize draws tied to product engagement, follower counts, or subscriber status.
Wheel spins, boxes, or chests. Any mechanic where the buyer pays for a chance to win one of several revealed outcomes.
Loot boxes. Any listing or promotion structured as a loot box, mystery chest, or gacha pull.
Prize ladders. "Spend $X, get a chance at Y" promotions where Y is itself variable or contingent on chance.
Tournaments with prize pools funded by entry fees. Pay-to-enter competitions with monetary prizes.
Giveaways conditional on purchase or Marketplace activity. E.g., "buy a pack, enter to win a PSA 10 Charizard." Unconditional giveaways on your personal social media, not linked to a HitScanTCG purchase, are not covered by this Policy.

2.3 Marketing framing

You may not market HitScanTCG listings as a chance to win, hit, or pull specific cards. Phrases to avoid in listing titles, descriptions, or stream promotions include: "chance to pull," "maybe you'll hit," "lucky draw," "prize inside," "winner," "your odds," or similar gambling- adjacent language. Acceptable framing focuses on the product purchase and the entertainment experience of a live opening: "Live opening of Paldea Evolved booster pack," "sealed booster box opening stream," "watch your pack open live."

2.4 Off-platform activities linked to your HitScanTCG store

If you run raffles, prize draws, mystery pack sales, or other prohibited chance-based activities on external platforms (Twitch, YouTube, Instagram, Whatnot, Discord, etc.) and those activities reference, promote, or are coordinated with your HitScanTCG store, you violate this Policy. You may run clearly-separated unrelated activities on external platforms; you may not use HitScanTCG as the buyer pool or fulfillment path for a prohibited off-platform promotion.

3. What IS Allowed

Retail pack opening is the core HitScanTCG experience. The following are explicitly allowed and encouraged:

Selling specifically-identified sealed booster packs, ETBs, booster boxes, tins, bundles, and similar sealed product at a fixed price.
Opening each purchased pack live on stream for the Viewer to watch.
Shipping all cards from the opened pack to the Viewer.
Running unconditional giveaways on your personal social media that are not tied to HitScanTCG purchases (e.g., "Follow me to enter a monthly booster giveaway," open to all followers without purchase).
Offering volume discounts ("buy 5 packs, get 10% off") as long as the discount is deterministic and applied to the fixed price.
Hosting skill-based competitions with no cash or prize pool funded by entry fees (e.g., a community deckbuilding challenge).
Displaying the scan and pricing overlay from the HitScanTCG Scanner Tool during your pack-opening streams.

4. Enforcement

First violation: Listing removal and a written warning. Minor unintentional violations (e.g., ambiguous listing title) may be corrected without penalty.
Second violation or willful violation: Immediate 30-day Streamer account suspension. During suspension, you may not list new products, but must fulfill any already-purchased orders or issue refunds.
Third violation or repeated willful violation: Permanent termination of Streamer status. Any Marketplace commission owed on completed orders is paid out per normal Stripe Connect schedule; any unresolved disputes or open orders are settled through the dispute process, after which the account is closed.
Criminal or civil risk to HitScanTCG: If your activity creates substantive legal exposure to HitScanTCG (e.g., a state regulator initiates inquiry based on your promotions), we may suspend or terminate your account immediately at any stage, regardless of prior warnings.

5. Reporting

If you see a listing or Streamer promotion that you believe violates this Policy, report it to trust@hitscantcg.com with a link to the listing or stream and a brief description. Reports are confidential; we do not disclose reporter identity to the subject of a report.

6. Updates

We may update this Policy as laws change or as we learn of new abuse patterns. Material updates will be announced to Streamers by email at least 14 days before the effective date. Your continued use of the Marketplace after the effective date constitutes acceptance.
